1. About The Nivaar Project

The Nivaar Project (hereafter referred to as "Nivaar", "we", "us", or "our") is a community initiative based at F12, Sector 8, Noida — 201301, Uttar Pradesh, India. Our mission is to redistribute gently-used professional clothing to individuals from economically disadvantaged backgrounds who are preparing for interviews, internships, and formal workplaces.

The Nivaar Project is not a registered company, trust, or NGO at the time of publication of these Terms. We operate as a voluntary community initiative. These Terms govern the relationship between Nivaar and all persons who interact with our website, forms, or services.

2. Acceptance of Terms

By accessing our website at nivaartproject.org or any sub-page thereof, or by submitting any form (donor, recipient, volunteer, or contact), you agree to be bound by these Terms and Conditions and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use our website or services.

These Terms apply to all users of the website, including donors, recipients, volunteers, partner organisations, and general visitors.

3. Donor Terms

By registering a donation with The Nivaar Project, you agree to the following:

  • All clothing donated must be your lawful property, or you must have the right to donate it on behalf of the owner.
  • You confirm that all items donated are clean, wearable, free from damage, stains, or strong odours, and appropriate for a professional setting.
  • You confirm that donated items are of the types we accept (shirts, blouses, trousers, blazers, formal dresses, skirts, cardigans, kurtas, kurta sets, salwar kameez sets, and dupattas) and do not include prohibited items (shoes, handbags, partywear, bridalwear, heavily embellished garments, damaged clothing, or casual loungewear).
  • Once dropped off, donated items cannot be returned to the donor. The Nivaar Project reserves the right to decline, dispose of, or redirect any item that does not meet our guidelines.
  • The Nivaar Project is not responsible for any loss or damage to items in transit to our drop-off location.
  • No monetary compensation or tax exemption is guaranteed. Acknowledgement letters will be issued upon receipt, and formal receipts will be issued once legal registration is complete.
  • You consent to the processing of your personal data as described in our Privacy Policy.

4. Recipient Terms

By submitting a recipient application, you agree to the following:

  • You confirm that you are applying in good faith and that the information provided is accurate to the best of your knowledge.
  • Clothing is provided entirely free of charge. You are under no obligation to purchase anything or make any payment.
  • Clothing is provided for personal professional use only. It must not be resold or redistributed for commercial gain.
  • The Nivaar Project makes no warranty as to the exact availability of sizes, styles, or types of clothing at any given time. We will make best efforts to fulfil your stated requirements.
  • Approval of applications is at the sole discretion of The Nivaar Project and its volunteers. We reserve the right to decline applications if demand exceeds supply or if eligibility criteria are not met.
  • You consent to being contacted by us regarding your application and, if you have optionally consented, regarding future availability.
  • You consent to the processing of your personal data as described in our Privacy Policy. Your data is kept confidential and not shared without your consent.

5. Volunteer Terms

By registering as a volunteer through our portal, you agree to the following:

  • You will perform your volunteer role honestly, with care, and in accordance with the values and guidelines of The Nivaar Project.
  • You will maintain the confidentiality of all personal information you encounter in the course of your volunteer work, including donor names, recipient details, and application data. This obligation continues after your volunteer engagement ends.
  • You will not access, copy, share, or use any personal data obtained through the portal for any purpose outside of your assigned volunteer functions.
  • You understand that volunteer engagement may be terminated at any time by either party, with or without cause.
  • The Nivaar Project is not liable for any injury, loss, or damage incurred during volunteer activities, except where caused by our direct negligence.
  • You consent to the processing of your personal data for volunteer coordination purposes, as described in our Privacy Policy.

6. Use of the Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Submit false, misleading, or fraudulent information through any form.
  • Attempt to gain unauthorised access to the volunteer portal or any other restricted section of the website.
  • Scrape, harvest, or collect data from this website using automated means.
  • Upload or transmit malicious code, viruses, or any material that could damage our systems.
  • Use our website in any way that could cause reputational or operational harm to The Nivaar Project.

We reserve the right to block access to any user who violates these Terms.

The name "The Nivaar Project" and associated branding may not be used in any public communication, fundraising campaign, or media without prior written authorisation.

8. Disclaimers and Limitation of Liability

This website and our services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

The Nivaar Project makes no representations or warranties about:

  • The suitability, quality, or fitness for purpose of any donated garment.
  • The availability of specific sizes, styles, or garment types at any given time.
  • The uninterrupted or error-free operation of this website.

To the maximum extent permitted by applicable law, The Nivaar Project and its volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of data, harm to reputation, or dissatisfaction with donated items.

Our total liability, if any, shall not exceed the value of the specific service provided to you at the relevant time.

9. Data Protection

The collection, storage, and use of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions.

We process personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act, India). You have the right to access, correct, and erase your data at any time by contacting hello@nivaartproject.org.

10. Termination of Access

We reserve the right to terminate or suspend your access to the website and portal at any time if we reasonably believe you have breached these Terms, provided false information, or acted in a manner inconsistent with the values of The Nivaar Project.

Upon termination, your right to use the website and portal ceases immediately. Obligations of confidentiality and data protection that survive by their nature will continue to apply.

11. Grievance Mechanism

12. Amendments

Continued use of the website or services after the effective date of any update constitutes your acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by and shall be construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Noida / Gautam Buddh Nagar, Uttar Pradesh, India.
